These general terms and conditions of use (the "Terms") govern access to and use of the Eagr platform, published by EAGR, a simplified joint-stock company (SAS) with a share capital of €14,329.90, registered with the Nanterre Trade and Companies Register under number 938 024 841, having its registered office at 3 rue Donatello, 92400 Courbevoie, France ("Eagr"), by any person holding an account (the "User").
Access to the Platform is provided as part of the subscription purchased by the User’s employer or principal (the "Client"), governed by the general terms and conditions of sale.

Access & Account
The User accesses the Platform using personal login credentials. They agree to keep them confidential and not to share them. Any activity carried out from their account is deemed to have been performed by them.
In the event of loss or unauthorized use of their login credentials, the User shall immediately notify their administrator or Eagr.

Call recording
The Platform records, transcribes, and analyzes connected calls and video conferences. The User agrees to inform their call participants of this recording at the start of the conversation, in accordance with the Client's instructions, and to respect any objections they may have.

Artificial intelligence features
Live Coach, analytics, scores, and AI Role Play are powered by artificial intelligence models. Their results may be incomplete or inaccurate.
These are aids: the User remains solely responsible for their words and decisions, and verifies important information before using it.

Who sees what
Each user sees their own calls, analyses, and scores. Managers can see those of their team members for coaching purposes. Access permissions are set by the client during setup.

Prohibited uses
The User specifically agrees not to:

to record a call without informing the other party;
•
to import illegal content, or data to which they do not have rights;
•
to attempt to access data belonging to other users or clients;
•
to copy, decompile, or extract the Platform, or circumvent its security measures;
•
to use the Platform to develop a competing service.

Availability
Eagr makes every effort to ensure continuous access to the Platform, but cannot guarantee uninterrupted availability, particularly in the event of maintenance or an incident with a third-party provider (telephony, CRM, video conferencing).

Intellectual Property
The Platform, its contents, and its trademarks are the property of Eagr. The User is granted a personal right of use, limited to the duration of the Client's subscription.

Personal Data
The User's data and call data are processed on behalf of the Client, who is the data controller. Information regarding this processing and the exercise of rights can be found in our privacy policy.

Suspension
Eagr may suspend an account in the event of a breach of these Terms of Service, a security risk to the Platform, or at the Customer's request.

Changes to the Terms of Service
Eagr may modify these Terms of Service. Users will be informed of any significant changes before they take effect. Continued use of the service constitutes acceptance of the amended Terms.

Applicable Law
These Terms of Service are governed by French law.
